3. WHO DECIDES THE BENEFITS OF WORKERS' COMPENSATION?

Your Georgia Legislature establishes the benefits and laws affecting Workers' Compensation.

4. WHAT STATE AGENCY REGULATES WORKERS' COMPENSATION?
A.
The State Board of Compensation is the regulatory agency. The Commissioner of Insurance approves rates and investigates fraud. Their addresses are:

5. WHAT IS THE MAXIMUM BENEFITS PAID IN GEORGIA?
A.
In Georgia, Medical is unlimited. Disability changes, depending on the average weekly wage of the injured employee and the current amount set by the Georgia General Assembly. Questions/concerns regarding benefits should be directed to the State Board of Compensation (See Question #4).

6. HOW IS MY PREMIUM DEVELOPED?
A.
(A) The Company starts by taking the class codes (defined work) and payrolls assigned to each one. (B) They apply your experience modification (can be debit or credit). (C) The Company adds an expense constant (usually $150). Important: All companies do not have the same cost for each class code. They should, however, be quoting the same class codes. Regardless of what you give them, actual premiums will be created by audit where actual payrolls and classes will be determined. When you are asking companies to bid you should require them to bid on the same payrolls by class. We encourage employers to shop several markets (Hope we are one you shop!).

7. SOME OF MY EMPLOYEES DO WORK IN MORE THAN ONE CLASS. HOW DOES THE CLASS GET ASSIGNED?
A.
As a general rule, employees are assigned the class where the work is considered more hazardous (creates the most premium). It is important to keep payroll records by class. Example: Clerical Work(CODE 8810) has a lower cost factor than Outside Sales(CODE 8742).

8. HOW CAN A LOSS PREVENTION SERVICE HELP US?
A.
In addition to helping you recognize preventable or controllable risks in the workplace, the Loss Prevention Service monitors your claims and works with you to manage your claims.

9. WHEN SHOULD I COMPLETE THE FIRST REPORT OF INJURY AND INFORM THE INSURANCE COMPANY OF AN INJURY?
A.
IMMEDIATELY! (Our company provides an "800" number for immediate reporting.) Report all claims and report promptly. The sooner a claim is reported, the cheaper it is to pay. That translates into lower premiums in the future.

10. IS THERE A CONNECTION BETWEEN AN EMPLOYERS'S LOSSES AND THE EMPLOYER'S PREMIUM?
A.
Yes. For Georgia insureds with a sufficient premium level, the NCCI promulgates an "Experience Modification" to increase an employer's premium for WORSE THAN EXPECTED LOSSES and lower the premium for LOWER THAN EXPECTED LOSSES.

11. CAN I SAVE FUTURE PREMIUM BY NOT REPORTING CLAIMS BUT PAYING THEM MYSELF?
A.
No. The Experience Modification only spreads a portion of the losses over future years as premium. In addition, your failure to report can cause the Compensation Board to fine you and can void coverage for a claim.
